Welcome to ESP Clay Target Diary (“the App”), developed and provided by Sean McConnell (“we,” “our,” “us”, or "developer", “the developer”). 

By downloading, installing, or using the App, you (“you”, “your” or "user", “the user”) agree to be bound by these Terms of Use. 

If you do not agree to these terms, do not use the App.

1. General Information

ESP Clay Target Shooting Diary is a clay target shooting scores and analysis application designed to help users record, view, and analyse shooting performance.

The App is offered for a one-time purchase fee as displayed on the applicable app store.

2. No Data Collection

The App does not collect, transmit, share, or process any personal data. All user data (such as scores and statistics) is stored locally on your device only.

3. License to Use

When you purchase and download the App, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or reverse-engineer the App.

• Distribute, rent, lease, or sublicense the App to others.

• Use the App in violation of any applicable laws or regulations.

4. Intellectual Property

All content and materials within the App, including but not limited to, text, graphics, icons, logos, images, software code, layout, features and design, are the exclusive, intellectual property of the developer and are protected by applicable copyright and intellectual property laws.

You may use the App and its content solely for your personal, lawful, non-commercial use in accordance with these Terms of Use.

You must not copy, modify, reproduce, distribute, display, or create derivative works from any part of the App without our prior written consent.

All rights not expressly granted in these Terms are reserved by the developer.

5. Disclaimer of Warranties

The App is provided “as is” and “as available” without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, reliability, or accuracy.

We make no guarantees regarding the accuracy or completeness of any data, analysis, or output produced by the App.

Your use of the App is entirely at your own risk.

6. Limitation of Liability

To the fullest extent permitted by law, the developer, its affiliates, officers, employees, or partners shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in any way related to your use or inability to use the App, including but not limited to:

• Loss of data or accuracy

• Device malfunction or data corruption

• Personal injury, property damage, or financial loss

• Any other damages, even if advised of the possibility of such damages

If, despite the above, liability is found, it shall be limited to the amount you paid for the App.

7. User Responsibilities

You are solely responsible for:

• The accuracy of any data you input into the App

• Ensuring your device is functioning properly

• Complying with all laws and safety rules related to shooting activities

The App is a scoring and analysis tool only; it does not substitute for proper training, safety practices, or professional judgment.

8. Updates and Modifications

We may update or modify the App at any time without notice.  Your continued use of the App after such updates constitutes your acceptance of the modified version and Terms.

9. Changes to These Terms of Use

From time to time, we may amend, update or modify these Terms of Use at our sole discretion. 

You agree that we are not required to provide specific or direct notice of any updates. It is your responsibility to review these Terms of Use periodically to stay informed of any updates. You can do this by checking this online Terms of Use document, where the “Effective Date” will be updated when changes are made.

By continuing to use the App, you are deemed to have accepted any changes and updated Terms of Use.

10. Termination

We reserve the right to suspend or terminate your licence to use the App if you violate these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

11. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law provisions.

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

You agree to submit to the authority of these courts for the resolution of any such matters.
